Cruel and Unusual Punishment

Cruel and unusal punishment is way too vague of a term. It doesn't even seem to be specifically defined in the text of the amendment. Given that it is, I feel as if the government wouldn't even enforce it very well. As with the Todd Willingham case, many people may have skewed views of certain subjects. In all honesty, I don't feel as if the death penalty is a proper form of punishment. I believe in a sort of almost-death penalty. If a serial killer is killed, he is relieved of any stress or any other problems he or she may have had. An almost-death penalty ensures that they are the same person being punished in one way or another.

I agree with you entirely on this matter. With so many things going on in this country, the Government really has become unable to enforce every little thing that would become needed if we sat down and tried to make the U.S. a "stricter" place. People all have their own opinions as to what should be going on in law, and as you said, many people have skewed views. I feel that is it is due to this that we can't truely define the term of "Cruel and Unusual Punishment." And I do also agree with the death penalty comment; death is a way out. In a way, we're offering them a freedom from what punishment we've given them.
